Member Rules &
Regulations

Welcome to Lynmar Racquet & Health Club. Our philosophy is to serve you, the member, in a courteous and professional manner and to encourage you to the
fitness level you wish to attain. Our philosophy does not include physical examinations or medical advice; only your own personal physician is qualified to advise you on the amount and type of exercise to fit your needs. We recommend
periodic check ups from your physician.
A member of Lynmar Racquet & Health Club assumes all responsibility for
exercising in his or her present physical condition. The staff will be happy to answer questions about the facilities and assist you in your pursuit to better physical fitness.
General Rules All members use the club facilities at their own risk. The club is not responsible for
any athletic injuries, or other injuries, sustained while using our facilities and club. Members utilizing club facilities should perform proper warm‑ups and prepare themselves for their game or workout.

Membership Club Cards Members must present their membership club card at the desk
upon entering the club. Club cards are issued to children who are in the
seventh
grade and above. If lost, a new membership card will need to be ordered,
and the member charged a $10.00 replacement fee. [index]
Locker Key & Towel A locker key and one large and one small towel per member may be obtained by presenting your club card at the control desks.
Keys and towels must be returned before leaving the
premises, or the following charges will be assessed:
Large towel ($5.00), small towel ($3.00), locker key
($10.00). [index]
Maintenance/Repairs Lynmar reserves the right to close any area of the club for new construction and/or repairs and maintenance without compensation to the
membership. Lynmar has the right to pre-empt facilities for special events. Lynmar also reserves the right to close any part of the facility that management may consider dangerous for use.

Permanent Combination Lockers Permanent lockers are available for rent on a semi‑annual basis. Check with bookkeeping for locker availability. Past due rental
lockers: Management has the right to empty the contents of locker and assign locker to another member. Lynmar will not be responsible for items that have to be removed.

Accounting Procedures Any checks returned due to lack of funds will be assessed a $25.00 returned check charge.
Monthly dues are billed
in advance (i.e., dues billed on the January 31 statement
are for February.) Those members still not on EFT (Electronic Fund Transfer) are expected to submit their monthly payment by the 5th of the month, and
a $20.00 late fee will be assessed on the 11th of the
month, to those accounts that have not been paid
in full. Any outstanding
balances, as of the 18th of the month, will be
assessed a 20% monthly finance charge, which will
appear on the following month's statement. This
finance charge will serve as the 30-day late notice
(no separate past due notices will be sent).
Member shall give written notice to the club of any change of address. Failing such notice, all communications shall be presumed to have been received within five days of mailing.

Past Due Accounts
Following the assessment of
finance charges (serving as 30-day notice of past
due account) any membership
account more than 45 days past due will be placed on a "CASH
ONLY" basis, and no goods or services may
be charged to the member account. If full payment
for the balance of the account has not been received
within 60 days, a letter will be sent to confirm the
delivery of the account to collection.
Collections If it is necessary for Lynmar Racquet & Health Club to take action in order to collect
on the amount owed by the member, the member agrees to pay all collection costs including court costs and reasonable attorney's fees or such other amount as directed by a court.

Questions about your Bill If you think
an error is reflected on your bill, or if you need more information about a
statement transaction, write us (on a separate sheet) at 2660 Vickers Drive, Colorado Springs, Colorado 80918 (the address shown on your bill) as soon as possible. We must
hear from you no later than 60 days from the
date of the first bill on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights.
In your letter, please provide the following
information:

Your name and account number.
- The dollar amount of the suspected error.

A description of the error and explanation, if
available, of why you believe there is an error.
- If you need more information, describe the item you are unsure about.
You do not have to pay any amount in question while we are investigating, but you
are still obligated to pay the parts of your bill that are not
under review. While we investigate your question, we
cannot report you as delinquent or take any action
to collect the contested amount. [index]
Change of Membership Status Club members may change their membership classification by a request in writing delivered to the sales/membership office. The club will make the necessary
fees/dues adjustment. If a member wishes to upgrade or downgrade their membership there will be a $10.00 processing fee.

Voluntary Resignation A member may terminate
their membership by completing a "Resignation Request
Card" in person with the sales/membership office. Along with the resignation request we ask that all membership cards be returned.
The "Resignation Request
Card" must be received 30 days prior to the membership being cancelled.
Cancellations received between the 1st and the 15th of the current month will be
effective that month; cancellation requests received after the 15th will take effect the following month. A cancellation will become effective once all pending obligations
have been met, otherwise the member shall remain liable for all dues and other indebtedness accrued.

Dues and Fees Dues,
usage fees and court fees are subject to periodic
adjustment by management.

Guest Policy & Fees
Guests are welcome to visit Lynmar for a per-visit
guest fee of $10 for adults
(19 and over) and $5 for those 18 and under.
Members may invite guests to accompany them to the
club, with payment - OR - by requesting a
complimentary guest pass, in advance, from the General Manager.
Local guests will be issued a one-time access pass;
out of town visitors may be accommodated for longer
periods.
- Liability & Fees: Hosting members and
their guests must check in at the front desk, pay
any
corresponding fees, and the guest must register and
sign the release of liability form, for insurance
purposes.

Instruction: Adult non-members
may take three (3) private lessons
or one (1) group lesson before
joining Lynmar. Junior non-members
under the age of 12 may take three
(3) private, or two (2) group
lessons prior to joining.
Non-member lessons and clinics are
upcharged by 20%. Once
introductory limits have been
reached, players must be prepared to
join Lynmar or discontinue use of
the facility.
- Conduct: Guests must abide by all rules and
regulations of the club, and the
sponsoring member is responsible for the
actions of guest. Violation by guest of
these rules and regulations and any
posted regulations of the club will
result in the removal of the guest.
Abuse of this policy will result in administrative action. [index]
Unacceptable Behavior In
the event of substantial complaints by fellow members or staff, or annoying or unacceptable behavior, a member may be suspended or expelled from
membership by the management. Inappropriate behavior by a member's guest can jeopardize that member's membership.

Court Use, Rules & Attire Proper etiquette, language and courtesy are to be observed at all times. This
includes proper conduct and relinquishing of courts on schedule. Violators will be asked to leave without refund. Shirts and shoes must be worn on the indoor tennis
courts, racquetball courts, in the workout area and all other public areas of the club. Non-marking court shoes must be worn on tennis and racquetball courts.

Indoor Reservations
- Indoor court fees currently in effect are:
5:30-8:00 a.m. = $10 an
hour;
8:00-4:00 p.m. = $12 an
hour;
4:00-10:00 p.m. = $16 an
hour;
10:00-11:00 p.m. = $5 an
hour;
Saturdays and Sundays = $12
an hour. Check with the
front desk for any changes. |
Tennis & Racquetball Courts Available indoor tennis court time may be reserved
up to one week (7 days) in advance, a 24‑hour notice is required to cancel reservations. On shorter notice, the member who made the reservations
will be
charged for the court time unless the court can be sold to another member. A reservation is considered a time reservation rather than a specific court reservation.
The receptionist reserves the right to assign courts which best utilize the available
time.
Hitting court walls (racquetball and tennis) and back curtains (tennis) intentionally with racquet will result in the loss of playing privileges.
Using black soled running shoes, cross trainers, or shoes that leave marks on the tennis courts will result in a $50 cleaning fee.

Outdoor Court Reservations Members are asked to sign in at the control desk and give the names of all players using the court. Members may reserve an outdoor
court up to 48 hours in advance at no cost. If the court is booked more than 2 days in advance, there will be a $4.00 per hour charge. For courts that are booked more
than 2 days in advance, the 24‑hour cancellation policy is in effect. There will be no cancellation charge if there would have been no court charge, or due to bad
weather. The receptionist reserves the right to assign courts which best utilize the available time. Proper tennis attire is required at all times.

Tennis Permanent Court Time Permanent court time (PCT) is the reserving of specific day and time for designated period of time.Permanent court time does not guarantee that you will get the same court each time
you play. It guarantees you will get a court at the same time each week. PCT contracts are available at the control desk. Members will be billed in two installments
prior to the start of the PCT session. There is no PCT during Holidays.

Exercise Area Instruction on the usage of the equipment is strongly recommended. Appointments may be made with the Fitness Director and Personal Trainers directly. Members
who have received instruction on usage of the equipment are allowed to use the equipment at any time during club hours. Members utilizing the exercise facilities
should take proper warm‑up time and prepare for their exercise.
Shirts and shoes must be worn while using any of the
fitness equipment.
Children 12 years of age or older may use all areas of the fitness center without adult supervision.
However, proper instruction, good behavior and a structured exercise program are strongly recommended. Children as young as 10 or 11 might be allowed in a
structured fitness program if they are big enough to use the equipment, receive proper instruction, obtain a program card signed by a parent, and are accompanied
by a parent at ALL times while in the fitness area. Children under 10 years old may not use any of the weight or cardiovascular equipment and cannot be allowed in the Cybex,
Circuit Training or free weight areas.
Children under 10 are allowed to be in
the cardiovascular room as long as a
parent is supervising them, and the
child is not using or playing on the
equipment. [index]
Swimming Pool Whenever there is no lifeguard on duty, children must be 14 years or older to swim
by themselves. Children under the age of 10 must be in the immediate supervision of an adult member, even when the lifeguards are on duty. We ask that members
shower before entering the pool. Running around the pool deck area is not permitted. Diving is not permitted, nor is hanging on the overhead door or pool
cover. Lounge chairs are provided for our members' use. No glass bottles are allowed in pool area. The swimming pool schedule changes periodically. Copies are available at the front desk.

Saunas, Whirlpools & Steam
Rooms Our saunas are designed as dry saunas. Members who desire humidity should use the steam rooms. Saunas, steam rooms and whirlpools should be used for only a
short period of time. Do not take a cold shower immediately after use for safety/health reasons. You can take a lukewarm one to avoid danger of shock.
Tanning Center The tanning center is exclusively for Lynmar members. Members can reserve time up to 7 days in advance. Tanning packages can be purchased at the racquetball
desk. Children should not be left unattended while members are tanning.

Lounge Areas After 6:00 p.m., children under the age of 14 are not permitted
in Sneakers unless accompanied by an adult. Food, beer, and liquor (health regulations' liability, and liquor license rules) are
prohibited to be brought in by members or their guests in all areas of the club. Alcoholic beverages are prohibited to be taken outside the club premises.

Children All children within 6 weeks to 8 years of age must be in
in the direct supervision of their parents at all
times within the club, i.e., swimming, eating in the lounge, etc.
- Children seven (7) and under may NOT be left unattended while in the club.
- No child beyond age three (3) will be allowed in locker rooms of the opposite sex.
Holiday Schedules
The club is closed on Thanksgiving Day, Christmas
Day and New Year's Day. Early closings (3:00 pm) are
scheduled for Easter Sunday, Memorial Day, Fourth of
July, Labor Day, Christmas Eve, and New Year's Eve.

Smoking Lynmar is a non-smoking
facility in its entirety. Smoking is not permitted in the club.
